Can Child Support Be Decreased?

Filed Under:

Question of the Day:

if the parent who is paying child support volunteered the amount of support because at the time they could afford the amount, but cannot now, can they have the amount lessened?  -- Amy

Answer:

Amy: Child support can always be modified if circumstances, like income, change through no fault of the person paying child support.  It can be changed by a Consent Order agreed to by the parties or by the Court if the parties do not agree.  At my law firm, we are seeing more and more requests for modification on alimony and child support , with the economy down and unemployment up.
