Mediation is a great option for people who are able to work with one neutral legal professional. Some clients who pick mediation may have elements of their agreement worked out and only need help with a few remaining issues. Some mediation clients have already made the transition to being separated and the emotional complexity of their divorce is diminished. Other clients choose mediation because it seems like the most pragmatic choice to work out the aspects of their divorce agreement together.

One option is that mediation can be conducted with strict communication rules between Unmani and her clients, with all negotiations occurring in formal session; or another option is it can be structured to maximize the clients’ ability to work together to find agreement outside of session time. Mediation can even be conducted with separate sessions for the clients, a form of mediation sometimes known as caucusing.

Values can guide the mediation process as much or as little as clients choose, and the same goes for the role of the law. In mediation, the clients are in control of the extent the law is looked to for guidance. When requested, Unmani gives clients neutral legal information in as much or as little detail as the clients think is best. When an agreement is reached, Unmani drafts a Marriage Settlement Agreement (MSA), and each spouse is given the option to have the MSA reviewed by a separate, independent attorney, before the agreement is filed with the court.
